Eddy County opposes new Clean Water Act policy

Eddy County sent a letter to the Environmental Protection Agency this week opposing the federal government's proposal to redefine water and land protection under the Clean Water Act. The proposed regulation, known as the "Waters of the U.S." rule, seeks to clarify what types of water fall under the protection of the Clean Water Act. Most seasonal and rain-dependent streams, as well as wetlands near rivers and streams, would fall under federal protection if the regulation is approved. However, Eddy County commissioners said they are "very concerned that the rule would expand regulations significantly within the boundaries of Eddy County." "The EPA has asserted that this will clarify the jurisdiction of the 'Waters of the U.S.,' but the proposed definitions are inadequately explained and raises important concerns and questions, if not answered will result in further legal challenges," the county commissioners wrote in a letter addressed to the EPA. Royce Pearson, a commissioner for District 2 in Artesia, said he is worried the new regulation would harm the area's oil and gas industry, as well as farmers and ranchers, by extending federal protection to any low spot, ditch or gutter that has the opportunity to hold water...more
